H. R. 2306

A BILL
To limit the application of Federal laws to the distribution and consumption of marihuana, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “Ending Federal Marijuana Prohibition Act of 2011″

SEC. 2. APPLICATION OF THE CONTROLLED SUBSTANCES ACT TO MARIHUANA.

Part A of the Controlled Substances Act (21 U.S.C. 801 et seq.) is amended by adding at the end the following:

SEC. 103. APPLICATION OF THIS ACT TO MARIHUANA.

  1. PROHIBITION ON CERTAIN SHIPPING OR TRANSPORTATION. -This Act shall not apply to marihuana, except that it shall be unlawful only to ship or transport, in any manner or by any means whatsoever, marihuana, from one State, Territory, or District of the United States, or place noncontiguous to but subject to the jurisdiction thereof, into any other State, Territory, or District of the United States, or place noncontiguous to but subject to the jurisdiction thereof, or from any foreign country into any State, Territory, or District of the United States, or place noncontiguous to but subject to the jurisdiction thereof, when such marihuana is intended, by any person interested therein, to be received, possessed, sold, or in any manner used, either in the original package or otherwise, in violation of any law of such State, Territory, or District of the United States, or place noncontiguous to but subject to the jurisdiction thereof.”
  2. PENALTY. -Whoever knowingly violates sub-section (a) shall be fined under title 18, United States 26 Code, or imprisoned not more than one year, or both.”

SEC. 3. DEREGULATION OF MARIHUANA.

  1. REMOVED FROM SCHEDULE OF CONTROLLED SUBSTANCES. -Schedule I of section 202 of the Controlled Substances Act (21 U.S.C. 812(c)) is amended—
    1. by striking “marihuana”; and
    2. by striking “tetrahydrocannabinols”.
  2. REMOVAL OF PROHIBITION ON IMPORT AND EXPORT. -Section 1010 of the Controlled Substances Importand Export Act (21 U.S.C. 960) is amended—
    1. by striking subparagraph (G) of subsection(b)(1);
    2. by striking subparagraph (G) of subsection(b)(2); and
    3. by striking paragraph (4) of subsection (b).

SEC. 4. CONFORMING AMENDMENTS TO CONTROLLED SUBSTANCES ACT.

  1. Section 102(44) of the Controlled Substances Act (21 U.S.C. 802(44)) is amended by striking “marihuana”.
  2. Part D of the Controlled Substances Act (21 U.S.C. 841 et seq.) is amended as follows:
    1. In section 401—
      1. by striking subsection (b)(1)(A)(vii);
      2. by striking subsection (b)(1)(B)(vii);
      3. by striking subsection (b)(1)(D); and
      4. by striking subsection (b)(4).
    2. In section 402(c)(2)(B), by striking “marihuana”
    3. In section 403(d)(1), by striking “marihuana”
    4. In section 418(a), by striking the last sentence
    5. In section 419(a), by striking the last sentence
    6. In section 422(d), in the matter preceding paragraph (1), by striking “marijuana”.
    7. In section 422(d)(5), by striking “, such as a marihuana cigarette,”

SEC. 5. CONSTRUCTION.

No provision of this Act shall be construed to affect Federal drug testing policies, and each Federal agency shall conduct a review of its drug testing policies not later than 30 days after the date of enactment of this Act to ensure that the language of any such policy is in accordance with this section.

    As the Cannabis Ambassador for the Serenity Senior and Veterans Center, I work with Seniors and Vets to get them off of chemicals that are killing them and on to more natural healing medicine. Everyday I hear a member tell me “Its a Miracle Anakka!” The healing benefits of cannabis, and the independence that follows for our seniors and Vets is indeed a miracle. It is time that the government allow people to make their own choice about how to heal themselves.

    Its time to end the domestic war on the American citizens and let our domestic green POW’s out of jail now…800,000 a year are arrested and put in jail at a cost of over a billion dollars a year. Lets put that money into education and jobs. Lets have the happy thriving America that we all know and love once again.

          I’m pretty sure it’s because that’s the way it’s spelled in the Controlled Substances Act. This bill is essentially a change to that Act so they need to write it specifically to match the wording it has.

      H.R. 2306 supporters decided to reach out to Representative Smith on June to let him know we considered HR 2306 sound public policy that deserved a hearing. Instead of addressing the concerns of the general public, Smith removed his page from Facebook and wiped it clean of any and all comments posted in support of the bill. Further commenting was also disabled on the page. Once one too many phone calls began coming into his congressional offices and the extension for the House Judiciary Committee, a prerecorded message was posted stating that his office was closed (Which it wasn’t, their operating hours on Friday are posted as until 6pm EST).

      ex-post facto… they stay in prison and finish out their sentences because it was law when they committed the crime. maybe there will be pardons, but changing laws does not mean people already convicted at the time the laws were in place are immediately released.

      Apparrently it will not pass either way, since it would need to go through committee processes that have already been decided by members not to be heard. Its seems the Patriot Act and Healthcare Reform is not the only thing our congressmen make decisions on without even reading the bills.

      Sorry folks, until we change the fact that most politicians are crooked and stop surrendering everything to others, nothing but a pipe dream. (which u cant even smoke with)

      I am a native Texan raised in the San Antonio area and very proud of my roots. I also served in the United States Army for 8 years, 1 of which was spent in Kosova and another spent in Iraq with the 101st Airborne Div therefore I feel that I have earned the right to speak with any politition that i so desire.I noticed that these days you are a very hard man to contact, thats really a shame, as an elected official anyone should be able to contact you at any time, however i had to jump through hoops to get here. With that said I would like to remind you that it was the people of the GREAT state of TEXAS the put you in office and if you continue going against your constituants I feel very secure in the fact that you will not be there much longer. If you pay attention to the tv or internet you will see that over 90% of americans are VERY MUCH FOR HR 2306. Please wake up and look at the facts. How can a plant that has never killed anyone be llegal however cigarettes and alcohol which has killed millions is perfectly legal. How is marijuana dangeres at 10%-30% potancy but Maritol the Pharmicutical version that has 100% potancy is concidered safe. Marijuana is less harmfull than the air we breath everyday. Marijuana was illegalized due to ignorance and false pretences and it is time the ignorance and all the lies coming from Washington come to a hault. The other day some said to me ” The fedral government has an awfull lot of power.” My response was ” Yes they do… because we gave it to them and if they are not carefull we WILL take it back.     If Cannabis weren’t both unique and essential, and we all weren’t getting radiated to extinction by UV-B and Fukushima, then this sort of legislation might be a welcome change to the cut-throat social evolutionary obscenity that is the prohibition of ‘marijuana.’

    As it is, in the context of the terminal trajectory we have created, then even this is too little, too late. Cannabis is critical to human survival !!!!

    This bill isn’t as potent as “essential civilian demand.” We need to cut the crap and start planting as fast as we can, while praying that we’re not too late to avoid global extinction, through synergistic collapse.

    What’s required is an immediate revaluation of Cannabis as a “strategic resource”"bearing seed” “of first necessity…” — All Cannabis strains, wherever we can, as much as we can, as fast as we can. NO TAX & NO LIMITATIONS OR REGULATIONS.

Lets make this happen people Im really trying to get high and/ or stoned. Its not fair that I cant be a humble netizen and become a gardener at the same time. Allowing states to determine their own marijuana policy flies in the face of Supreme Court precedent.” Of course there are no facts to support these statements.

    My name is Joe American, a political activist and advocate for ending the failed “war on drugs.” I am contacting you today regarding your falsified attack on Rep Ron Paul and Barney Frank’s bill to decriminalize cannabis at the federal level. Not only have our drug laws failed, but in most cases they are illegal! Now prepare yourself for the truth, and the proof that these laws are illegal.

    1st off I’m going to begin with the severability clause in the controlled substances act of 1970: ”Any provision of this title (see Short Title of 2000 Amendments) held to be invalid or unenforceable by its terms, or as applied to any person or circumstance, shall be construed as to give the maximum effect permitted by law, unless such provision is held to be utterly invalid or unenforceable, in which event such provision shall be severed from this title and shall not affect the applicability of the remainder of this title, or of such provision, to other persons not similarly situated or to other, dissimilar circumstances.”
    You will find this clause in Title 21 “Food and Drugs” Chapter 13 “Drug Abuse Prevention and Control” Subchapter I “Control and Enforcement” Many political officials have admitted that the “war on drugs is a failure”

    2nd I’m going with the medical factor: As a schedule 1 controlled substance cannabis would be required to have NO accepted medicinal value. Well this is clearly not true that cannabis is not accepted medically. This one might just blow your mind congressman!
    US Patent 663057 titled “Cannabinoids as antioxidants and neuroprotectants” which is assigned to The United States of America, as represented by the Department of Health and Human Services.
    The patent claims that: “Cannabinoids have been found to have antioxidant properties, unrelated to NMDA receptor antagonism. This new found property makes cannabinoids useful in the treatment and prophylaxis of wide variety of oxidation associated diseases, such as ischemic, age-related, inflammatory and autoimmune diseases. The cannabinoids are found to have particular application as neuroprotectants, for example in limiting neurological damage following ischemic insults, such as stroke and trauma, or in the treatment of neurodegenerative diseases, such as Alzheimer’s disease, Parkinson’s disease, and HIV dementia.”

    This patent was obtained in October of 2003.

    There is also US Patent 7109245 that was issued September 19, 2006 titled “Vasoconstrictor cannabinoid analogs” The patent discloses that:

    “The present disclosure concerns pharmaceutical compounds and compositions that are useful as vasoconstrictors, and the use of these compounds, for example in the treatment of shock. Septic shock is a type of vasodilatory shock that is often accompanied by a clinical presentation that suggests infection, such as fever, chills, warm, flushed skin, and hemodynamic instability (characterized by a falling and rising blood pressure). Septic shock is an often fatal condition that accompanies severe microbial infections, frequently with gram-negative bacteria such as Escherichia coli (esh-uh-rik-ee-uh koh-lahy), Pseudomonas aeruginosa (soo-doh-moh-nass ah-ridge-in-oh-sa) and Klebsiella or Bacteroides species. Gram-positive bacterial infections can also lead to septic shock, particularly those infections caused by Staphylococcus aureus (staff-ill-oh-kok-us ore-ee-us) and the Pneumococcus (noo-muh-kok-uhs). The bacterial infections can be acquired by routes such as ingestion, personal contact, or trauma, but infections are often nosocomial consequences of therapeutic procedures, including implantation of indwelling catheters or prosthetic devices. Septic shock often occurs in immunocompromised subjects, and therefore has been an increasing problem in recent years because of the increasing number of individuals who are immunocompromised. For example, subjects with HIV disease or who are taking immunosuppressive drugs for the treatment of cancer or organ transplantation rejection are at increased risk of developing septic shock. In view of the above, there exists a need for agents that counteract the vasodilation associated with shock.
    Summary:

    The present inventors (George Kunos and Raj K. Razdan) have demonstrated that abnormal cannabidiol (Abn-cbd) is a selective agonist and cannabidiol is a selective antagonist of an as yet unidentified cannabinoid-like or non-classical receptor distinct from the known cannabinoidreceptors CB1 and CB2. Agonists of these receptors, such as Abn-cbd, are believed to cause vasodilation. Even cannabidiol itself, which is generally an antagonist of the putative receptor, has been found to cause some vasodilation, and it therefore acts as a partial agonist, or mixed agonist/antagonist. It would therefore be desirable to have an agent that acts as a pure, or substantially pure, antagonist at the CB1-like receptor. Such an agent would be particularly useful in the treatment of diseases in which hypotension is the result of the action of endogenous cannabinoids and drug-induced vasoconstriction is desirable, for example in hypotensive states, such as shock. The antagonist would have particular application in vasodilatory shock states, such as septic shock, but it could also be used to achieve selective hemostasis to stop bleeding induced by trauma or surgery.”

    3rd I will inform you about property rights violations, and by the way congressman, you will find this to be in the law books as well. As well by advocating the war on drugs you are in violation of this law, as is anyone else who continues to enforce these laws:

    Officials have no right to take life, freedom, or property (life/murder, freedom/enslave, property/theft). Drug laws are invalid as they prohibit ownership of property & violate a right to contract. They’ve slowly increased power of the police to violate other rights of privacy, further property rights infringement procedures where the state keeps the property even if there are no charges pressed against the person the property was stolen from. As the constitution protects our liberty, making it illegal to own property is in conflict to the constitution making these laws invalid. Any enforcement of these laws is punishable under US Code Title 18-Crimes and Criminal Procedures – - Part I-Crimes – - Chapter 13-Civil Rights – - Sections 241&242

    Since you own your life, you are responsible for your own life. You do not rent your life from others who demand your obedience. You are also free from the chains of enslavement and cannot be forced to do anything against your will. Any laws that deprive someone of their unalienable rights to life, liberty, and the pursuit of happiness by limiting their choices is in direct violation of the concepts of liberty, and as liberty is a protected right under the constitution these laws are invalid.

      Actually it was first made illegal in texas in the 1930′s as a way of discriminating against unwanted mexican immigrants. Marijuana was used regularly by this cultural group and it was the easiest way they could think of to send them back across national lines. The fervor was spread across the U.S. quickly and by 1937 the marijuana stamp act was passed stating that you must possess a stamp to possess marijuana. Unfortunately, you had to have the marijuana, breaking the law, to get the stamp and the U.S. never issued the stamp effectively making it illegal. It actually harks back to who I believe was John Hancock being caught illegally transporting wine for which he had not obtained a tax stamp. This arrest by the british set off a revolt in the americas known now as the revolutionary war. Hmm, how quickly we forget our history.

    I’m just an average person with an average job as a salesperson. However, my company says I have no job without clean urine.

    After passing 3 screens in the past 6 months, they wanted another one tomorrow. I said no. I expect to be fired or w/o job tomorrow/

    This is what the war on drugs has done to the average person. To get another average job, I’m sure they will request the same. I realize that this (drug testing) is actually an illegal search (of a person’s body) as defined in the 4th amendment. For the life of me I cannot understand why we have allowed it come to this. But WE have been silent and afraid of being found out for too long and we are all paying the price.

    The fact that Rep Lamar Smith of Texas has the power to ignore this bill, which could give me a normal life again, is far removed from what our founding fathers would tolerate.

    We need to speak up RIGHT NOW, or it will never stop.

    I finally did speak up. I joined my local Norml, I wrote Smith, I wrote my local rep, and I said no to my employer.

    I am no longer silent. I was silent for too long. I am no longer afraid of who will see me on a blog, board, or whatever.

    I will not easily allow Lamar Smith to tell me what my position is society should be or how well my kids should eat. Smith’s failure to DO HIS JOB and get the bill into the House is un-American.

    So, fellow Texans, fellow Americans, the time is NOW. We may not get this chance again for a long time. Please act.

That includes people of all voting ages including the elderly that would rather be allowed to consume this safe plant rather than dangerous pharmaceuticals.This also includes the middle class, upper class, working citizens, at least 40 million Americans.

      Bravo I agree! I am a senior and I approve this message. I think it is time for “WE THE PEOPLE” to get back our inailable rights to prusue happiness in how ever you choose to apply it with Cannibus.
      Many of my friends use it and I prefer them using cannibus to alcohol or pharma drugs. Big Pharma companies are lobbying
      against this bill passage that is probably Mr.Texas Congressman is so set against it as well. Makes you wonder who pays his bills so he can wollow in comfort and own serveral homes I’m sure. Ok I think I’ve said everything except I’ve already sent my approval to my Representive’s in Washington St. And I got three of the same responses from each one which only makes me work more diligently at getting heard.     I am a disabled veteran (rated 100% permanent) who uses cannabis for pain relief. I never experimented with cannabis prior to becoming disabled, and only tried it after my wife made the suggestion and a friend gave me a sample to try. Prior to using cannabis the VA had me on morphine (liquid and pill form), 7.5mg hydrocodone and a wide variety of antidepressants. After a week or two of using cannabis I found I no longer needed most of what was being prescribed. I had been on those drugs for years and cannabis made leaving it behind very easy (little to no withdrawals). If not for cannabis I would still be addicted to all that junk and facing my days in a much less active and enjoyable state. Thanks to cannabis not only do I have less pain but I also have less anger issues (chronic pain can make you VERY cranky toward those around you). I pray with all of my heart that the prohibition on this very useful plant is lifted and others in the same situation get to enjoy life once more.

      It takes about a month to go through xanax withdrawals. Just keep slowly reducing the daily dose. I have done this twice, on my own, using pot. It was painful but tolerable only because of cannabis. I cannot believe they are using the word “marihuana” in this bill. That word was invented to criminalize users. The stuff is Cannabis, varieties of which can be used to make oil, fiber, protein food for humans and animals, paper products, wood alternative and more. Just think of the jobs and businesses a simple law ENDING Prohibition were passed NOW. They got their $2 Trillion which will inevitably end what’s left of the middle class. Now, free the non-violent Americans taking up space reserved for violent felons like the illegal aliens who pass through the revolving door system. We are allowing a dictatorship in D.C.

      read the damned bill, people. it’s in english and is pretty transparent as to its purpose. they are going to make it so the feds have no jurisdiction over marijuana or thc anymore, giving the states the right to decide for themselves…

      without thc or marijuana being in the controlled substances act of 1970, it would pave the way for states that have already made medical marijuana laws to do their business without federal meddling and it would pave the way for states that are afraid to change their laws to do so.

    The time for legalizing marijuana is now! I read more than half this thread, and everyone on here that I read was for legalizing marijuana. that may be a coincidence, however, I spend a lot of time bored poking around threads, and this has been the case with every single one of them! that is not a coincidence, everybody posting on this thread and others NEED to tell their represenatives in congress their feelings and opinions! It hardly takes longer to write an email to congress or call congress than it takes to post on a thread, so next time you get the urge to voice your opinion, please take the time to make the judgement call and realize that writing nearly the same thing in a letter to congress that you would post on a thread like this will go a lot farther and actually help to fix the situation you are upset about.

    It is currently legally considered fact that legalizing marijuana would be dangerous and stupid, so congress isn’t going to come to the conclusion that marijuana needs to be legalized on their own. The government doesn’t listen to the news, it doesn’t read threads online, the only viable source of information the government takes are the pre-existing official information that has guided laws in the past, in a manner of speaking, while the nation has moved on to realize that marijuana and cannabis can do more good than evil if legalized, they’re still taking notes on the film Reefer Madness. It is up to the people to contact the government and do two things:

    1. Catch them up that marijuana and hemp would do far more good for the country if legalized.

    and

    2. Let them know that the people at this point are in favor of marijuana legalization!

    …and let democracy run it’s coarse.

    Democracy can only run it’s coarse, however, if people are in contact with their government and let them know that that is what the people want.

    So everybody who believes in marijuana legalization, write your represenatives! Let them know! tell your friends to do the same! everyone needs to do their part in order for this legislation to pass!

    I do not understand section 2. It appears to retain government control. With the recent SNAFU by the ATF, the DEA must have no legal involvement with cannabis;. Decriminilizating Cannabis in the United States must be straightforward and clear. The word “marihuana/marijuana” is a political term invented to criminalize users. Varieties of cannabis are a cheap, oxygen-making natural resource grown without water or pesticides. Farmers call it a good rotation crop. Varieties of cannabis can be used to manufacture oil, fiber, protein food for humans and animals, paper and more. We are already importing it to make wood-alternative products, and its fiber can be used as an alternative to cotton so we do not have to subsidize south american cotton farmers (that’s a $2billion savings right there)..

    Pot is no gateway drug. It does not harm the human body. It has documented medical uses, and should be treated as a garden plant. Manufactured products will generate sales tax. Because this law is destroying the lives of non-violent Americans and wasting jail space, there should be hearings to free currently incarcerated Americans convicted for breaking illegal laws. See Michaelson’s that references existing laws which makes this prohibition is illegal.

    thank god were giving this another shot! if crime rates went down for Holland i bet they will for us. hell if everyone shared a joint wed probably all be pacifists and happy tokers! i also want to use it for medical benefits such as chronic back and knee pain, anorexia, and since i have control over my usage it helps with my depression without me being dependent on it. it also makes the self conscious people less self conscious and those people are able to be more comfortable in their day to day life. I think penalties and fines are necessary so there isn’t smoking and driving or buying for minors. it has worked pretty well with cigarettes not to mention cigs. kill you weed helps those suffering so you tell me which one should really be legal.

    Repeal all cannabis hemp laws immediately! There has never been, nor is there now a legitimate reason to regulate this beneficial plant / holy herb. It’s prohibition has caused unmeasured death and planetary distraction due to cannabis treatable diseases and the never ending global war for oil interests. “Marihuana” was not made illegal because it was a threat to society, it was outlawed as a means to erradicate the Hemp species as a whole. Remember that the compound THC was not isolated until the 60s. Learn the real history of the Cannabis Hemp plant, you will be amazed and you will be pissed off at what this government has attempted to do.

    It takes only the smallest bit of common sense to see that removing the prohibitions on marijuana would immediately legitimize and bring above-board the multi-billion-dollar cannabis and paraphernalia businesses, AND make room in our prisons for DANGEROUS criminals whom we allow to walk our streets.

    Think of how many cops and teachers we could hire across the country with all the money we’d save on legal and logistical costs. And think of all the extra billions circulating through the legitimate economy and the tax system.

    The only possible reason our representatives have so far resisted passing a bill like this is because their big donors don’t get to slice a chunk off for themselves. So, we just gotta replace their asses in Washington come next November if they fail to come through on this bill.

    this bill should be enacted asap…should have been done during Bill Clinton;s term…If anyone out there knows someone who is ill and can benefit from medical marijuana, then they know how important this is..My GF would have benefited from it greatly had she survived chemo for liver disease..it has so many uses and benefits that those with more knowledge than me can talk about….please support this measure,,,,,,tell your members of Congress. I do not support Rep Paul for president over the President, but wishhim well withhis progressive ideas within a Republican party that cares nothing of little people, those ill, or without insurance…Run as a Libertarian, Mr,Paul, republiclowns do not buy into your and my progressive ideas.

    EVEN IF IT WAS STILL “ILLEGAL FOR INGESTION”, it’s a CASH CROP!!! Its potential for demand and usage in almost every industry and service makes it a cash crop.
    A LOT of farmer’s (both old and new) would be able to work for a decent living. They wouldn’t need the the FEDERAL SUBSIDIES like most of our agriculture industry needs today, just to stay afloat. It would cause a boost in NEW products (or a change for the better in how existing products are made) creating NEW PRODUCTION jobs, a GROWTH in GDP and a change from a service economy back to a manufacturing one.
    IT’S SIMPLE MATH PEOPLE !! Unfortunately, there are BIG anti hemp lobbyists (re: Big oil, Chemical, Big pharma, the Koch’s..etc) that won’t let it happen. Don’t even get me started on the BENEFITS to our personal health or the environment.
    YES!! Even if it was still illegal for person consumption, :( I’d still support it for all of the above reasons!
